These Terms & Conditions (“Terms”) govern your access to and use of the Lake Creek Academy Fund for Learning website (the “Site”) and any related online services provided by Lake Creek Academy Fund for Learning (“LCA Fund,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Lake Creek Academy Fund for Learning is a registered 501(c)(3) nonprofit organization supporting Lake Creek Academy. Our Site provides information about our mission, programs, and ways to support our work.

Donation acknowledgments/receipts. We may send donation confirmations or receipts to the email or mailing address you provide. You are responsible for providing accurate information.

No goods or services. Unless explicitly stated otherwise, donations are made without receiving goods or services in return.

6) Refund policy

Donations are typically voluntary and non-refundable. However, we may consider refund requests in limited circumstances (e.g., duplicate transactions, suspected fraud, or clear processing error). To request review, contact us with transaction details. We reserve the right to approve or deny requests consistent with applicable law and processor policies.

7) Intellectual property

The Site, including text, images, graphics, logos, videos, design, and other content (collectively, “Content”), is owned by or licensed to LCA Fund and is protected by intellectual property laws.

You may view, download, and print Content for your personal, non-commercial use, provided you do not remove proprietary notices. You may not copy, reproduce, distribute, modify, create derivative works, or exploit Content for commercial purposes without our prior written permission.

8) User submissions

If you submit content to us (e.g., messages, feedback, testimonials, photos, or other materials), you represent that you have the right to do so and that the submission does not violate law or third-party rights.

You grant LCA Fund a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your submission for our nonprofit purposes (such as program promotion, fundraising, and communications), unless you clearly state in writing that you do not grant such permission.

We may remove or decline to publish any submission at our discretion.

To the fullest extent permitted by law, our total liability for any claim related to the Site will not exceed $100.

You agree to indemnify and hold harmless LCA Fund and its officers, directors, employees, volunteers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Site

• Your violation of these Terms

• Your violation of any rights of another person or entity

• Any content you submit to us

14) Changes to the Site or Terms

We may modify, suspend, or discontinue the Site (in whole or in part) at any time. We may also update these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date. Your continued use after changes means you accept the updated Terms.

15) Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Montgomery County, Texas, and you consent to that jurisdiction and venue.
